1. Acceptance of Terms
By downloading, installing, or using CrashKit ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
CrashKit is a mobile application designed to help users document vehicle accidents through photos, GPS data, timestamped records, and information collection. The App generates reports intended to assist with insurance claims and personal record-keeping.
3. Not Legal Advice
CrashKit is a documentation and organizational tool only. Nothing in this App, including checklists, guides, tips, generated reports, or any other content, constitutes legal advice. The information provided is for general informational purposes only. Laws regarding accidents, fault, insurance, and liability vary significantly by state and jurisdiction.
Always consult a licensed attorney in your area for legal advice specific to your situation. Do not rely solely on CrashKit reports in any legal proceeding.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. You must be at least 18 years old to create an account.
5. User Data & Privacy
Your accident reports, photos, and personal information are stored securely in your account. We do not sell your personal data to third parties. Please review our Privacy Policy for full details on how we handle your data.
6. Accuracy of Information
CrashKit does not guarantee the accuracy, completeness, or legal sufficiency of any report generated by the App. GPS coordinates may be subject to technical limitations. Timestamps are generated by your device and may vary. Users are responsible for verifying all information in their reports.
7. Accident Detection Feature — Important Limitations
CrashKit includes an optional accident detection feature that uses your device's motion sensors (accelerometer) to attempt to detect sudden impacts. This feature has significant limitations and must not be relied upon as your primary safety system:
- Accident detection varies by device — results depend on the make, model, hardware quality, and operating system version of your phone. It may not function on all devices.
- The feature only works when the CrashKit app is open in your browser or installed as a native app. It does not operate in the background on web browsers when the app is closed or the screen is locked.
- The feature may produce false alarms — sudden movements such as dropping your phone, slamming a car door, or driving over potholes may trigger the alert.
- The feature may fail to detect certain accidents, including low-speed collisions, gradual impacts, or incidents where the phone is not in the vehicle.
- Accident detection is provided as a convenience tool only and is not a substitute for calling emergency services (911), seeking medical attention, or contacting law enforcement after an accident.
- CrashKit LLC makes no warranty, express or implied, regarding the accuracy, reliability, or performance of the accident detection feature.
- CrashKit LLC shall not be held liable for any injury, damage, or loss arising from the failure of the accident detection feature to activate, or from any action taken or not taken based on a detection alert.
By using the accident detection feature, you acknowledge and accept these limitations.
8. Limitation of Liability
To the maximum extent permitted by law, CrashKit and its operators shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to reliance on any report, checklist, or information generated by the App.
9. Acceptable Use
You agree to use CrashKit only for lawful purposes and in connection with genuine accident documentation. You may not use the App to generate fraudulent reports or misrepresent accident circumstances.
10. Intellectual Property
All content, features, and functionality of CrashKit are owned by CrashKit and protected by intellectual property laws. You may not reproduce, modify, or distribute any part of the App without express written permission.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of significant changes via the App or email.
12. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
